In plain English: Katala’s Website and many of our Services are developed and hosted on Wix.com. Wix.com is a software company providing web development services through the use of online drag and drop tools. Wix.com may collect and process information regarding our Visitors and Users, solely on our behalf and at our direction. As the “Controller” of our Visitors’ and Users’ information, we are solely responsible for your information, including its legality, security, and integrity. Wix.com has no direct relationship with our Visitors or Users and if you are one of our Visitors or Users, please only contact us directly.

Katala is hosted and developed on Wix.com. Wix.com is an Israeli software company, providing cloud-based web development services. It allows Visitors or Users to create HTML5 websites and mobile sites through the use of online drag and drop tools.

Katala relies on Wix.com to collect, store and process certain Non-Personal and Personal Information from our Visitors and Users, solely on our behalf and at our direction. For example, each of our Visitors or Users is required to provide their first and last name, and an email address upon registering with Katala. This information is collected and then stored with Wix.com, on behalf of Katala.

 

For such purposes, Wix.com serves and shall be considered as a “Processor” and not as the “Controller” (as both such capitalised terms are defined in the European Union General Data Protection Regulation) of our Visitors’ and Users’ information. Since Katala controls and operates its own website, we are considered to be the Controller of our Visitors’ and Users’ information and are responsible for complying with all laws and regulations that may apply to the collection and control of such Visitors’ and Users’ information, including all privacy and data protection laws of all relevant jurisdictions. Subject to applicable law, Wix.com will process our Visitors’ and Users’ information in accordance with the Data Processing Agreement located here. Note that as the Processor of our Visitors’ and Users’ Personal Information, if we request Wix.com to remove such information, Wix.com will respond to such requests within thirty (30) days. Unless otherwise instructed by us, Wix.com will retain our Visitors’ and Users’ Personal Information for the period set forth in Section 12: “Data Retention”.

 

We, Katala, are responsible for the security, integrity, and authorised usage of your Personal Information. Finally, we are additionally obliged to inform you that your Personal Information will be transferred to and processed by Wix.com, as the Processor of your data, on our behalf. 3.1 Un-identified and non-identifiable information pertaining to a Visitor or un-identified User, which may be made available to us, or collected automatically via their use of our Website or any of our Services (“Non-Personal Information”). Such Non-Personal Information does not enable us to identify the Visitor or User from whom it was collected. The Non-Personal Information collected by us mainly consists of technical and aggregated usage information. This may include, but is not limited to, Visitors' and Users' browsing and ‘click-stream’ activity on our Website or any of our Services, heatmaps and scrolls, non-identifying information regarding the Visitors’ or Users’ devices (such as the operating system, internet browser, screen resolution, language, and keyboard settings), internet service providers, referring/exit pages, date/time stamps, etc.

 

3.2 Individually identifiable information. Namely this is information that identifies an individual, may with reasonable efforts cause the identification of an individual, or may be of a private or sensitive nature (“Personal Information”). The Personal Information collected by us mainly consists of contact details (e.g., first name, last name, and email address for any User with a Katala account), billing details (first name, last name, physical billing address, payment method, and transaction details for any User with a Paid Subscription), details regarding a browsing or usage session (IP address, geolocation, and/or device unique identifier), details regarding connected third party accounts (such as the email or username for a connected PayPal account), correspondences (including those made through or uploaded to our Services), and any other Personal Information provided to us by Visitors and Users through their access to our Website and any use of our Services. For the avoidance of doubt, any Non-Personal Information that is connected or linked to Personal Information (for example, in order to improve our Website and any of the Services we offer) is deemed and treated by us as Personal Information, as long as such connection or linkage exists.

 

4. How We Collect Information

5. Why We Collect Information

6. Where We Store Information

 

In plain English: We may store and process Personal Information in the USA, Europe, Israel, or other jurisdictions, whether by ourselves or with the help of our affiliates and service providers, including Wix.com. The data storage providers of Wix.com, and therefore Katala, are contractually committed to protect and secure your data. Among other things, Wix.com adheres to the EU-U.S. Privacy Shield Principles and to the Swiss-U.S. Privacy Shield Principles, for further protecting and enhancing our Visitors’ and Users’ privacy. Some jurisdictions require us to maintain and store their residents’ information locally. We may also collect, process, store, and use such information elsewhere, including in the USA.

 

6.1 Our Visitors’ and Users’ Personal Information may be stored in Wix.com, or Wix.com affiliates’, data centres located in the United States of America, Ireland, South Korea, Taiwan, and Israel. Wix.com may use other jurisdictions as necessary for the proper delivery of their Services and/or as may be required by law (as further explained below).

 

Wix.com is based in Israel, which is considered by the European Commission to be offering an adequate level of protection for the Personal Information of EU Member State residents.

 

Wix.com affiliates and service providers that store or process your Personal Information on Katala’s behalf are each contractually committed to keep it protected and secured, in accordance with industry standards and regardless of any lesser legal requirements which may apply in their jurisdiction.

6.2 The following disclosure is regarding Wix.com’s commitment to the EU-U.S. Privacy Shield and Swiss-U.S. Privacy Shield.

 

Wix.com participates in, and has certified its compliance with, the EU-U.S. Privacy Shield Framework and the Swiss-U.S. Privacy Shield Framework. Please note that permanently deleting your Katala account erases all of your information from Wix.com's databases. After completing this process, you may still use the public aspects of the Katala Website, but your User Account and all its data will be removed permanently, and neither Katala nor Wix.com will be able to restore your account or retrieve your data in the future.

 

6.3 Data Localisation Obligations

 

If you reside in a jurisdiction that imposes “data localisation” or “data residency” obligations (i.e., requiring that Personal Information of its residents be kept within the territorial boundaries of such jurisdiction), and this fact comes to Wix.com’s attention, they may maintain your Personal Information within such territorial boundaries, if they are legally obligated to do so.

You acknowledge that while doing so, Katala and Wix.com may continue to collect, store and use your Personal Information elsewhere, including in the United States of America as explained above.

If you do not wish to receive such promotional messages you may notify Katala at any time, follow the “Unsubscribe” instructions contained in the promotional communications you receive, or unsubscribe from non-essential communications directly here.

8.2 Service and Billing Messages

Your data is your right and it is essential you have control over your Personal Information. That is why Katala has taken steps to enable you to access, receive a copy of, update, amend, delete, or limit the use of your Personal Information.

 

Before disclosing the requested Personal Information, we may ask you for additional information in order to confirm your identity and for security purposes. We reserve the right to charge a small fee where permitted by law and will exercise this right where we feel it is necessary (e.g., if your request is unfounded or excessive).

10. Use of Cookies and Other Tracking Technologies

10.2 Clear GIFs
